These Terms of Use ("Terms") govern your use of the Layer Accordingly mobile application (the "App"), operated by Layer Accordingly LLC, a Florida limited liability company ("we," "our," or "us"). By downloading or using the App, you agree to these Terms.
The App is provided for personal, non-commercial use only. You may use the App to discover, track, and layer fragrances for your own personal enjoyment. You may not use the App for any unlawful purpose or in any way that violates these Terms.
You must be at least 13 years of age to use the App. If you are under 18, you should review these Terms with a parent or guardian.
The App, including its name, logo, design, text, graphics, and software, is the property of Layer Accordingly LLC and is protected by applicable intellectual property laws. The name "Layer Accordingly," the tagline "build your signature scent by layering," and all associated branding are trademarks of Layer Accordingly LLC.
You may not copy, reproduce, distribute, modify, or create derivative works of any part of the App without our prior written consent.
Fragrance information displayed in the App is sourced from the Fragella API and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or availability of any fragrance data. Fragrance availability, pricing, and formulations may change without notice.
Layering recommendations and compatibility scores are generated algorithmically based on accord data and are intended as suggestions only. Individual results may vary based on personal preferences, skin chemistry, and other factors.
The App and this website contain affiliate links to third-party retailers including Amazon, and may in the future include links to Sephora, Ulta, Scentbird, and other retailers. We may earn a commission if you make a qualifying purchase through these links at no additional cost to you. Layer Accordingly LLC is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. As an Amazon Associate, Layer Accordingly earns from qualifying purchases. Affiliate links inside the App are clearly labeled "ad" near the retailer button. These retailers are independent third parties and we are not responsible for their products, pricing, availability, or policies.
The inclusion of a retailer link does not constitute an endorsement or recommendation of that retailer or any specific product.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Layer Accordingly LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App, if any.
We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Continued use of the App after changes to the Terms constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Florida.
